12. Clean Air Act Compliance

Custom tuners and all entities that engage in activities related to the emission system of a vehicle, such as making or installing custom tunes, are subject to the regulations stipulated by the Clean Air Act (CAA) in the United States. The Act was created by the Environmental Protection Agency (EPA) to regulate air emissions and protect air quality.

Here's a brief overview of what that means for custom tuners:

  1. Emission Limits: The Clean Air Act sets emission standards for certain pollutants. These limits apply to all vehicles, including those that have been custom tuned. It's essential that any tune does not result in emissions that exceed these standards.
  2. Tampering with Emission Control Devices: The Act prohibits tampering with or removing any device or element of design that has been installed on a vehicle to comply with emission standards. This means tuners must not disable or bypass such devices, even if doing so would potentially increase performance.
  3. Defeat Devices: Under the Act, it's also illegal to manufacture, sell, or install a part for a motor vehicle that bypasses, defeats, or renders inoperative any device or element of design installed to comply with emission standards. Any tunes that operate as "defeat devices" are illegal.
  4. Certification and Testing: In some cases, tuners may need to have their tunes certified by the EPA to demonstrate compliance with emission standards. This typically involves testing by an EPA-approved laboratory.
  5. Record Keeping: Entities subject to these regulations may also need to maintain records demonstrating their compliance, which the EPA can request to see during inspections.

Non-compliance with these regulations can result in severe penalties, including fines and potential criminal charges. It's important to note that these regulations apply to all vehicles sold in the U.S., regardless of where they were manufactured or tuned.

However, some exemptions exist for vehicles used solely for competition or off-road, but these exemptions are specific and don't apply broadly. For the most part, if a vehicle is used on public roads, it must comply with the Clean Air Act. Therefore, custom tuners should be mindful of the Act's guidelines to avoid any potential issues.

Remember to always seek legal counsel when unsure about the compliance status of your activities. Laws and regulations can change and interpretations can vary.
